Terms of Service (or TOS for short)

Artist's Commitment


As an Artist, it is my personal duty to provide my clients with the best service possible. I hereby pledge to:
 

  • Keep contact in a consistent and efficient manner to maintain the best possible service to my clients by providing them with Works in Progress (WIPs) of any work throughout the entirety of its progress to ensure the picture is something my client is happy with every step of the way. My email address is available as is a phone number for all clients to reach which can be found in the contact section.

  • I value you as a client and as a person. I understand that things come up, paychecks are slimmer than expected or other expenses arise. If there is a financial issue, please let me know and we can work something out. 

  • I will do my best with what I'm given. While I don't strive for perfection (if I did, nothing would ever get finished!), I do want a satisfied customer and a piece of art that is visually pleasing. The more information I'm provided with about a character, the better the work. I do care about your characters personality, interactions and things like that. Feel free to link me to stories and as many reference images as you'd like. If your links are hosted externally, I am not responsible if that site is unavailable and I will put your commission on hold until I get something suitable. 

  • I will fix things! If on a status update there's something you'd like changed, please don't be afraid to ask. My only request is to think about how you're wording it. A little forethought goes a long way. If a pose is wrong, the details aren't right, please link me to a description or a reference so I know what you're looking for!

  • Anyone can see the information about the commission on my Trello (this includes reference pictures, and details of the commission as to what the commissioner wants, this can be opted out if you are not okay with it and your commission will be set to anonymous with a vague description)  I do this for 2 reasons:

    • To give potential costumers an educated guess as to where their commission might be in the waiting queue and how far previous works have come along.

    • To keep personal track of all commissions I get and not forget important details (if given)

 

Usage For Private commissions: I reserve the right to use any image I create as I see fit. This includes, but is not limited to, producing and selling prints or portfolios (print or CD) and/or posting to my online galleries (resized and usually watermarked). I retain full commercial and distribution rights on any image I produce unless an agreement is worked out stating otherwise. Typically, in doing commercial work(logos, labels, etc) the commissioner/buyer does inherit legal rights to the work. 

 

Commissioners MAY NOT redistribute the art for profit (selling prints/pay-sites). Beyond that, the commissioner may use the art in whatever way they please as long as credit is given. This includes posting to your own gallery. Modification -IS- permitted by the commissioner, ONLY. If the commissioner wishes to use their commissioned work on Secondlife, Steam Sprays, or a profile icon for various websites, they are more than welcome.

Edits

Edits will be made under 2 circumstances for free:

  1. The mistake was entirely my fault as I might have overlooked something

  2. The Edit in question is not very big and can easily be done with no major work done to the piece

As stipulated on the first paragraph of Artist Commitments I provide WIPs of the work in question including  in the following phases: sketch, line art, coloring, shading (in that order) and any other edits done in between those phases. The costumer may ask for edits at this point in time and will be done at no extra charge as long as they are reasonable edits and don't take an unreasonable amount of time.

Any mayor edits done in later phases of the piece that should have been brought up earlier by the aforementioned WIPs sent to the costumer will be charged depending on the requested edit.

 

   

Payments and Refunds

 

 

I send an invoice through paypal to the costumer, a link to this terms of service  are included in the invoice for review before purchase, and by paying the invoice you are accepting this TOS.

I use U.S. Dollars as my currency, so when sending payment please be sure to convert it if necessary. I accept PayPal ONLY for commissions that are made over the internet, if possible please pay with cash, HOWEVER, I am not responsible for payments lost via mail so be sure to get tracking when sending money. If sending Cash or Money Order, please make them out to "Marco Alfaro".

 

 For customers with large orders, arrangements to pay via small increments can be made, however, work will not be completed until full payment is received. I require 100% as a down payment on large orders before work is started. This is non-negotiable. It is against Paypal's TOS to use their services for any adult content, and I do my best to stay within their Terms of Service. If using PayPal, the commissioner will please list their payment for 'services' instead of 'goods' unless the piece is traditional. I get the full name and mailing address of the customer otherwise. NOTE: I know that marking a payment as a "gift" makes it fee-free, but please don't. Paypal is providing me a service and so I will give them their fee. Also, if the payment is marked as a gift, PayPal will not issue refunds, so this rule is for the both of us! -Refund Policy- There are NO refunds on completed work. Once the work is completed, the most I can do for you is make minor changes. That is why I send commissioners sketch, and ink previews of their image. When purchasing from an auction, all sales are final and you agree to my ToS upon purchase. If the piece is damaged within transit, it is not my fault. I go through great lengths to make sure your piece is packaged securely and will arrive to you safely. If it does not, it is out of my hands to deal with. If you have some sort of destruction, please take photographic evidence of the package with all of the packaging present, the item that was damaged, and explain the damages. I will dispute it over the insurance I purchased for the product with the Post Office. It is the most I can and will do in this situation as I cannot help poor mail service. And I also must protect myself when dealing with someone I do not know.
